    General

    Why ship must be registered?

    There are two main reasons why a ship should be registered. One is to establish the identity of the shipowner and the other is as evidence of the nationality of the ship. Registration also allows mortgages to be registered and the ship be pledged as security. Registered ships can claim privileges and sovereign protection from the flag state too.

    Must all ships be registered?

    There are three categories of ships that need not be registered. They are

    · Ships that do not exceed 15 net tonnage
    · Licensed ship
    · Local fishing vessel of 500 GT and below

    In what circumstances do I need to re-register and register anew?

    Registry Anew is a process by which the current particulars of a ship, including her Official Number, her ownership and any encumbrances, are re-entered in the Register Book under a new port number.

    Re-registry is the term used when a vessel whose registry under the Ordinance has been previously closed becomes the subject of a fresh application for registry. Examples of events leading to re-registry are:-

    (a) Registry closed on sale of ship to foreigners, repurchased back by Malaysian and registered back as Malaysian ship.

    (b) Registry closed on abandonment of ship as a wreck or constructively lost but subsequently recovered.

    (c) Registry closed following application to licence under Boat Licensing Rules. Ship subsequently sold to another Malaysian requiring title registry.

    (d) Registry arises after condemnation of a ship by a competent court

    What are the changes that must be notified to the registrar?

    The Registrar must be informed of any changes that affect the information in the Certificate of Registry, for example, change of address.

    How to register a ship?

    Before a ship can be registered, the ship’s name has to be approved. The application for ship name can be made at any port of registry office. Upon the approval of the name, application to register a ship can be made at any port of registry office of your choice.

    In most circumstances, a provisional certificate of registry will be issued for a maximum period of six months pending the carving and marking of ship’s name and port of registry.

    What are the documents required for the registration?

    Documents that shall be furnished with the application are
    * Application to register
    * Declaration of eligibility
    * Original documents such as Builders Certificate (for new ship), Bills of Sale, Invoices, Title of Evidence, etc.
    * Certificate of Survey for Tonnage and measurement issued by Marine Surveyors. If the vessel is over 24 meters in length, an International Tonnage Certificate 1969 is required * Certificate of Company Incorporation if owner is a body corporate
    If the vessel is coming off from a foreign register, a deletion certificate and an extract of their register

    How do I effect the change of ownership?

    In the case of an individual owner, the appointed Ship Manager or the owner himself may effect the change of ownership at the Registry office. He will need to submit : .

    * A copy of Identification Card
    * Appointment of Ship Manager
    * Declaration of Eligibility
    * Original Bills of Sale going back to the last registered owner
    * Original Certificate of Registry

    In the case of corporate ownership;

    * Declaration of Eligibility
    * Appointment of Ship Manager
    * Original Bills of Sale going back to the last registered owner
    * Certificate of Incorporation
    * Memorandum and Article of Association
    * Certificate of Incorporation of Company (Form 9)

    How do I effect changes of ship particulars?

    Before notifying the registrar of the changes of ship’s particulars, a surveyor shall inspect the ship to verify the changes and issue a Certificate of Survey.

    For change in engine particulars, the documents to be submitted are

    * Certificate of Survey
    * Original Certificate of Registry
    * Marine 255 – Pin 1/99 form which has been
    * Survey 118 – Declaration of the machinery


    For change in ship’s tonnage, the documents to be submitted are

    * Certificate of Survey
    * Original Certificate of Registry
    * Marine 255 – Pin 1/99
    * A copy of Tonnage Certificate

    How to register a mortgage?

    Essentially, there are two kinds of Mortgages, one is to secure a loan of Principal Sum with interest and the other is to secure an Account Current or similar transactions. The application to register a mortgage shall be accompanied by appropriate mortgage forms (Form 247/249/251), an original or certified true copy of Deeds of Covenant. There are fees to be paid which are calculated based on the tonnage of the ships.

    Am I entitled to registry my ship?

    The qualifications to register a ship as a Malaysian ship are:

    * The owners of the ship are Malaysian citizens
    * If it is owned by a company, the company must be incorporated in Malaysia
    * The company shall have a principal office in Malaysia
    * Majority of the shareholding are held by Malaysian citizens
    * Majority of the directors are Malaysian citizens


    Where to register a ship?

    The ports of registry in Malaysia are Port Kelang, Penang, Kota Kinabalu and Kuching.


    Malaysia International Ship Registry

    Am I entitled to own a Malaysia International Registry ship?

    The qualifications to own a Malaysia International Registry ship are

    * Corporation is incorporated in Malaysia
    * Office is in Malaysia
    * Majority of the shareholders are not Malaysian
    * Paid up capital of at least 10 % of the value of the ship or one million Ringgit Malaysia, whichever is higher


    Where can I register my ship as Malaysia International Registry?

    Port of Registry Office of Malaysian International Ship Registry is located at Marine Department of Labuan office, Federal Territory of Labuan

    Is there any restriction to register ships under the Malaysia International Ship Registry?

    To register a ship under the Malaysian International Ship Registry, the ship shall meet the following criteria:-

    * Fitted with mechanical propulsion
    * Not less than 1,600 gross tonnage
    * Not more than 15 years if it is a tanker or a bulk carrier
    * Not more than 20 years if it other than above

    Apakah keperluan yang ditetapkan untuk memohon penubuhan pusat latihan maritim?

    Permohonan penubuhan pusat latihan maritim hendaklah dibuat terus kepada Ketua Pengarah Laut, Jabatan Laut Semenanjung Malaysia. Keperluan dan panduan permohonan boleh merujuk pada NMPM 1/99.

    Apakah alamat pusat latihan maritim yang ada menawarkan kursus-kursus modular mengikut konvenysen STCW 95?

    Pusat latihan maritim yang telah diluluskan oleh Jabatan Laut dibawah perlaksanaan konvensyen STCW 95 adalah seperti yang tersenarai dalam http://www.marine.gov.my/service/Pusat%20Latihan.pdf. Anda bolehlah terus menghubungi pusat latihan berkenaan bagi tujuan kursus.

    Saya ingin mendapatkan pemeriksaan perubatan sebagai pelaut, klinik manakah yang perlu saya tujui?

    Apakah syarat-syarat untuk menjadi seorang pengamal perubatan yang diluluskan oleh Jabatan Laut?

    Pemohon hendaklah mengisi borang permohonan JL/HEPP/B/10 dengan lengkap dan menghantar terus kepada Ibu Pejabat Laut Semenanjung Malaysia dengan menyertakan salinan dokumen yang telah disahkan benar seperti berikut:

    i) Satu (1) gambar warna saiz kad pengenalan

    ii) Salinan Kad Pengenalan

    iii) Sijil kelulusan kedoktoran

    iv) Sijil MMC

    Bagaimana hendak memperolehi borang permohonan, borang laporan bagi pemeriksaan perubatan?

    Bilakah Jabatan Laut akan mengadakan peperiksaan perakuan kekompetenan bagi bagi calon-calon bahagian dek dan injin?

    Saya ingin membuat pembelian buku/penerbitan Jabatan Laut. Bagaimanakah caranya dan berapakah bayaran yang dikenakan?

    Anda boleh membuat pembelian penerbitan yang dikehendaki di Wisma Pelaut Pelabuhan Kelang atau di Pulau Pinang. Untuk maklumat lanjut sila rujuk pada NMPM 19/1999 bagi senarai-senarai penerbitan serta bayaran yang dikenakan.

    Saya ingin memohon Perakuan Pengiktirafan (COR), apakah syarat-syarat yang perlu dipenuhi?

    Permohonan Perakuan Pengiktirafan hendaklah dibuat di Pejabat-Pejabat Pelabuhan yang berdekatan dengan mengisi borang JL/HEPP/B/03 dan menyertakan salinan dokumen-dokumen seperti yang digariskan dimukasurat 2 borang tersebut. Untuk makluman lanjut bolehlah merujuk pada NMPM 25/2000 dan NPM 9/1999.

    Berapakah bayaran yang dikenakan bagi permohonan Perakuan Pengiktirafan?

    Bayaran bagi setiap permohonan adalah mengikut jenis permohonan seperti berikut :-

    i) Permohonan baru : RM 600.00

    ii) Permohonan Pembaharuan : RM 600.00

    iii) Rosak/Hilang : RM 100.00

    Bayaran hendaklah dibuat dalam bentuk Wang Pos, Kiriman Wang, atau Bank Draf atas nama Pengarah Wilayah berkenaan.

    Berapa lamakah proses pengeluaran Perakuan Pengiktirafan?

    Sijil Perakuan Pengiktirafan akan diproses dalam masa 3 bulan berdasarkan tarikh penerimaan permohonan yang lengkap.

    Pemegang Sijil Perakuan Kekompetenan (COC) dari Negara manakah yang layak untuk memohon Perakuan Pengiktirafan?

    Perakuan Pengiktirafan boleh dikeluarkan kepada pelaut tempatan dan pelaut asing yang berkhidmat di atas kapal Malaysia yang memiliki Perakuan Kekompetenan yang dikeluarkan oleh Negara luar yang menandatangani MOU dengan Malaysia.     Berapa lamakah tempoh sahlaku Sijil Perakuan Pengiktirafan?

    Tempoh sahlaku Perakuan Pengiktirafan (COR) tidak lebih dari 1 tahun, jika sekiranya tempoh sah laku Perakuan Kekompetenan (COC) kurang dari 1 tahun, maka tempoh sah laku COR adalah mengikut tarikh tamat sah laku COC tersebut. Tempoh sah laku COC semasa permohonan COR dibuat hendaklah tidak kurang daripada enam (6) bulan bagi membolehkan COR diproses.

    Saya ingin memohon Dokumen Keanggotaan selamat (Safe Manning Document) apakah keperluan-keperluan yang perlu dipenuhi?

    Garispanduan bagi Permohonan Dokumen atau Perakuan Keanggotaan Selamat boleh didapati melalui laman web berikut http://www.marine.gov.my/service/notice/mgn/nmpm512004.pdf

    Permohonan hendaklah mengisi dengan lengkap borang seperti dalam Lampiran 1a dan Lampiran 1b dan menghantar permohonan tersebut kepada Ibu Pejabat Laut, Jabatan Laut Semenanjung Malaysia.

    Berapakah bayaran yang dikenakan bagi permohonan Dokumen Keanggotaan Selamat?

    Bayaran akan dikenakan setelah permohonan diluluskan dan dokumen tersebut hanya akan diserahkan kepada pemohon setelah menjelaskan pembayaran. Jumlah yang perlu dibayar adalah bergantung pada jenis permohonan seperti yang dinyatakan dalam NMPM 51/2004.

    Berapa lamakah proses pengeluaran Dokumen Keanggotaan Selamat?

    Permohonan Dokumen Keanggotaan Selamat akan diproses dalam tempoh satu (1) bulan berdasarkan tarikh penerimaan permohonan yang lengkap.

    Jika sebuah kapal ingin memiliki lebih dari satu Dokumen Keanggotaan Selamat apakah keperluan-keperluan yang perlu dipenuhi?

    Sebuah kapal boleh memiliki lebih dari satu Dokumen/Perakuan Keanggotaan Selamat bergantung pada satu-satu jenis pelayaran iaitu ’Domestik, Near Coastal atau Unlimited’. Keperluan-keperluan yang perlu dipenuhi adalah seperti yang digariskan dalam NMPM 51/2004.

    Berapa lamakah tempoh sahlaku Dokumen/Perakuan Keanggotaan Selamat?

    Tempoh sahlaku Dokumen/Perakuan Keanggotaan Selamat adalah selama lima (5) tahun.

    BAHAGIAN KESELAMATAN PELAYARAN


    SOALAN-SOALAN LAZIM

    1. SOALAN : Berapakah jumlah bilangan kapal yang melalui Perairan Selat Melaka dalam jangkamasa satu tahun?

    JAWAPAN : Jumlah bilangan kapal yang melalui Perairan Selat Melaka dalam jangkamasa satu tahun adalah dianggarkan kira-kira 60,000 sehingga 70,000 BUAH. (Merujuk kepada statistik jabatan)

    2. SOALAN : Berapakah jumlah kemalangan kapal yang seringkali berlaku di Perairan Selat Melaka dalam setahun?

    JAWAPAN : Jumlah kemalangan kapal yang sering kali berlaku di Perairan Malaysia sebanyak 1 atau 2 jenis kejadian kemalangan yang serius dalam masa satu tahun.

    3. SOALAN : Apakah tindakan yang akan diambil oleh pihak Pusat Komunikasi Maritim sekiranya berlaku sesuatu kemalangan yang serius di Perairan Selat Melaka?

    JAWAPAN : Uuntuk makluman, tugas MRCC (dikenali sekarang sebagai Pusat Komunikasi Maritim) telah diambil alih oleh Agensi Penguatkuasaan Maritim Malaysia (APMM), sekiranya MRCC mendapat sesuatu aduan, Pusat Komunikasi Maritim hanya akan menyalurkan aduan tersebut kepada pihak APMM untuk tindakan selanjutnya.

    4. SOALAN : Apakah yang dimaksudkan dengan alat bantuan pelayaran?

    JAWAPAN: ALAT BANTUAN PELAYARAN adalah suatu peralatan atau sistem atau gabungan kedua-duanya yang memberi pedoman atau panduan kepada Pelaut bagi memastikan pelayaran mereka berada di laluan yang selamat. Alat bantuan pelayaran yang disediakan oleh Jabatan Laut ialah RUMAHAPI, TANDARAH SUAR, PELAMPUNG PANDU, SISTEM PELAYARAN SATELIT(SISPELSAT) DAN SISTEM PENGENALAN OTOMATIK(AIS).

    5. SOALAN : Apakah kegunaan Rumahapi ?

    JAWAPAN : Tujuan Rumahapi dibina adalah untuk memberikan pedoman atau petunjuk kepada pelaut-pelaut untuk menentukan kedudukan mereka pada sesuatu masa dan ianya juga sebagai penandaan pintu laluan keluar masuk sesuatu perairan.

    6. SOALAN : Apakah yang dimaksudkan dengan kerlipan lampu yang dipasangkan pada sesuatu rumahapi?

    JAWAPAN : Kerlipan lampu yang dipasangkan pada alat bantuan pelayaran adalah untuk membezakan diantara satu rumahapi dengan rumahapi yang lain yang mana kerlipan lampu tersebut secara tersendirinya akan memaparkan identiti sesuatu rumahapi tersebut.

    7. SOALAN : Berapakan jarak maksimum cahaya lampu yang dipasang pada rumahapi dapat dilihat?

    JAWAPAN : Jarak maksimum cahaya lampu yang dipasangkan pada sesuatu rumahapi adalah berbeza-beza kerana ianya bergantung pada ketinggian lampu, jenis lampu, keadaan cuaca dan ketinggian pemerhati. Kebanyakan Rumahapi di Malaysia mempunyai julat maksimum cahaya lampu kira-kira 23 batu nautikal.

    8. SOALAN : Apakah kegunaan Tandarah Suar?

    JAWAPAN : Tujuan pembinaan Tandarah Suar adalah untuk menandakan alur pelayaran, batuan, beting dan lain-lain. Tandarah Suar mempunyai binaan tetap di sesuatu lokasi yang telah ditetapkan.

    9. SOALAN : Apakah kegunaan pelampung pandu yang telah dipasangkan di sepanjang Perairan Malaysia?

    JAWAPAN : Pelampung Pandu merupakan pelampung yang terapung di permukaan air yang telah diikat dengan rantai (kili-kili) dan pemberat yang diletakkan ke dasar laut. Tujuan dipasangkan pelampung pandu ini adalah untuk menandakan had lebar alur pelayaran, penandaan kapal karam, labuhan dalam, kawasan bahaya dan lain-lain di sepanjang Perairan Malaysia yang bertujuan memberikan panduan kepada pengguna-pengguna perairan.

    10. SOALAN : Sekiranya berlaku kerosakan atau kecurian pada peralatan alat bantuan pelayaran yang dipasangkan sepanjang Perairan Malaysia,, kepada siapakah aduan kerosakan perlu dilaporkan?

    JAWAPAN : Sebarang aduan kerosakan boleh dilaporkan kepada pegawai di Ibu Pejabat dan Pusat Komunikasi Maritim, pegawai bertugas di wilayah masing-masing di talian berikut untuk tindakan selanjutnya.

    1. What are the requirements to establish or set-up new maritime training institutions?

    Application for establishment of maritime training institution shall be made to the Director General of Marine Department Peninsular Malaysia. Please refer to the guidelines for accreditation of training institutions offering approved courses to seafarers as in NMPM 1/99.

    2. What is the address of maritime training institutions that provides modular courses under the STCW 95 Convention?

    The address of an approved maritime training institution can be downloaded from http://www.marine.gov.my/service/Pusat%20Latihan.pdf. You may want to contact directly to the institution for more details.

    3. Which clinic should I attend for a seafarer medical examination?

    You may attend to any panel clinic that received approval by Marine Department. The list of approved medical practitioner can be downloading from http://www.marine.gov.my/service/doctorlist.pdf

    4. What are the requirements to be an approved medical practitioner by Marine Department?

    Applicant need to fill-in the application form JL/HEPP/B/10 completely and send it to Marine Headquarter together with all the credentials (Certified True Copy) as follows:

    i) One (1) color photo (Identification Card photo size)

    ii) Copy of Identification Card

    iii) Certificate of Medical Practitioner

    iv) Copy MMC certificate

    v) Copy of diploma/degree in Occupational Health/ Medicine or Certificate of attendance of Familiarization course conducted by Marine Department.

    5. How can I get the Application form and also related form regarding medical certificate?

    6. When will Marine Department conducting examination for Deck and Engine Department candidate?

    Examination schedule can be review and downloaded from www.marine.gov.my under Marine Guidance Note (NMPM)

    7. How do I buy a Marine Department publication by postal order?

    You can buy the publications at ‘Wisma Pelaut Pelabuhan Kelang’ or ‘Pulau Pinang. For more information regarding postal order, please refer to NMPM 19/1999.

    8. I would like to apply for Certificate of Recognition (COR), what are the conditions which need to be met ?

    The application for the COR shall be made at the nearest Port Office by filling JL/HEPP/B/03 form and attaching all authenticated copies of documents stated in page 2 of the above form. Please consult Marine Information and Guidance Note (NMPM) 25/2000 and (NMPM 9/1999.

    9. How much is the required fee to be paid for each Certificate of Recognition ?

    The fees are prescribed as follows :-

    i) New Application : Malaysian Ringgit 600.00
    ii) Renewal Application : Malaysian Ringgit 600.00
    iii) Damaged / Lost : Malaysian Ringgit : 100.00

    10. How long does it take to process the application ?

    Certificate of Recognition shall be processed within 3 months from the date in which the fully completed application has been received.

    11. Holders Certificate of Competency from which countries are eligible to apply for the Malaysian Certificate of Recognition

    The Certificate of Recognition shall be issued to local seafarers and foreign seafarers whom intend to serve on board Malaysian Registered Ship whom are holding a valid certificate of competency issued by a foreign country which has signed a Memorandum of Understanding (MOU) with Malaysia.     12. What is the validity of the Certificate of Recognition ?

    The validity for each Certificate of Recognition shall not exceed 1 year, should the validity of the exisiting COC is less than 1 year then the validity shall be in accordance to the exisiting COC. COC shall be not less than 6 months validity in order for the COR application to accepted and processed.

    13. I would like to apply for Safe Manning Document , what the conditions which need to be complied ?

    The applicant has to complete the forms as in attachment 1a and Attachment 1b and submit the completed forms together will the required attachments and addressed them to the :- The Marine Headquarters, Marine Department Of Malaysia.

    14. How much is the fees prescribed for the application of Safe Manning Document ?

    The payment shall be affected upon the successful approval of the application and the document will only delivered to the applicant upon receipt of the full payment. The amount for precribed shall be in accordance to the NMPM 51/2004

    15. How long does it take for the issuance of the Safe Manning Document ?

    The application would be processed within 1 month from the date in which the complete application has been received.

    16. If a vessel needs to obtain more than 1 Safe Manning Document, what would the conditions be ?

    A vessel may obtain more than 1 Safe Manning Document subject to a particular type of voyage ie ”Domestic, Near Coastal or Unlimited . The Conditions has been prescirbed in the NMPM 51/2004

    17. What is the validity of the Safe Manning Document ?

    The validity of the Safe Manning Document shall be 5 years.
